2016 JNU Sedition Case: Kanhaiya Kumar, Umar Khalid And 8 Others Named As Main Accused In Delhi Police’s 1200-page Chargesheet.

The Delhi Police on Monday filed its chargesheet in a court against former Jawaharlal Nehru University Students’ Union (JNUSU) president Kanhaiya Kumar in a sedition case lodged in 2016.

The chargesheet has been filed under IPC section 124A (sedition), 323 (voluntarily causing hurt), 465 (forgery), 471 (using as genuine, forged document), 143 (punishment for unlawful assembly), 149 (unlawful assembly with common object), 147(rioting), & 120B (criminal conspiracy).

Kanhaiya Kumar, Umar Khalid, Anirban Bhattacharya, Aquib Hussain, Mujeeb Hussain, Muneeb Hussain, Umar Gul, Rayeea Rasool, Bashir Bhat, among others have been named in the chargesheet.

Metropolitan Magistrate Sumit Anand put up the chargesheet for consideration before a competent court on Tuesday. Former JNUSU General Secretary Shehla Rashid and DMK leader D Raja’s daughter Aparajita Raja have also been named in the 1200-page chargesheet.

The case relates to raising of “anti-national” slogans on JNU campus on February 9, 2016 during an event to mark the death anniversary of Parliament attack convict Afzal Guru.

According to sources, here are seven students from Jammu and Kashmir who have been named in the chargesheet. Police have also found a video of Kanhaiya giving a speech at the event.

Witnesses also told the police that Kanhaiya knew in advance about the incident was among the people who raised the slogans. The police alleged that Kanhaiya was inciting, being part of the mob shouting “anti-India slogans”.

There are total 10 video clips which have been attached as evidence by the police. Police have named 90 witnesses in the chargesheet.

A case was registered on February 11, 2016 under Sections of 124 A (sedition) and 120B (criminal conspiracy) of the IPC against unknown persons at Vasant Kunj (North) police station following complaints by BJP MP Maheish Girri and the ABVP.

The February 9 event happened despite the varsity administration having cancelled the permission following a complaint by the ABVP, who had termed it as “anti-national”.

Exclusive details of the slogans that were allegedly raised at the JNU campus have been accessed from the chargesheet. Slogans included:

PM Modi that at least after 3 years, chargesheet has been filed. We will not oppose this. There is a political vendetta behind this.

The matter relates to the events of February 9, 2016, when a programme was organised at the JNU premises to protest against the hanging of 2001 Parliament attack convict Afzal Guru and Maqbool Bhat, during which anti-national slogans were raised. Kanhaiya Kumar and others had been arrested and later released on bail by the Delhi High Court.
